This Agreement is between Air Crash Consultants by its agent ["ACC"] and the person specified below in Pilot Data, an experienced pilot ["Pilot"] collectively known as the "Parties," for consulting services re airline crashes and other miscellaneous issues regarding airplanes and/or air travel. All such discussions, materials reviewed, and opinions given shall be strictly confidential and shall not be disclosed to anyone outside this Agreement.

Under no circumstances will the Pilot be asked or required to testify as to his opinions or his service to ACC. Under no circumstances will the Pilot disclose this Agreement, his opinions or the materials he reviewed to anyone outside the Parties to this Agreement. In the unlikely event either Party is compelled to disclose the Agreement or any discussions, materials reviewed, or opinions given thereunder, by a court of competent jurisdiction, that Party shall give 30 days written notice of such compelled disclosure at the addresses listed below.

The Pilot's review of materials, discussion, advice, and opinions is used as one of many in-house investigation and research tools to evaluate potential aviation litigation. As such, Pilot agrees to give his best, good faith opinion regarding the situation presented to him. ACC will not hold Pilot liable in any way whatsoever for his good faith opinion and/or advice to ACC.

The flat fee or hourly fee that Pilot will charge ACC for the services listed above will be negotiated on a case by case basis and such fee agreement will be attached as an addendum to this Agreement and will become a part of this Confidential Consulting Agreement.
